Chargers linebacker Steve Foley, who now proudly sports two entry wounds in the back of his leg, and another in his back, has filed suit against the city or Coronado and the off-duty police officer who pulled the trigger. The suit alleges negligence and excessive force.Any time a guy gets shot three times in the back, I'd think "excessive force" would be pretty easy to prove. I'm not a lawyer, but that seems like a slam dunk to me.
The damages that Foley's seeking are unspecified. His salary for this season was $775,000, and his career is probably over. No one's saying that his career is over, but he's 31 years old, his lawyer says it's "doubtful" that he'll play next year, and it's hard to imagine any team giving a contract to a 33-year-old linebacker who hasn't played a down in two years and just came back from three gunshot wounds.
A lot of perfectly healthy 33-year-old linebackers have trouble getting teams to take a chance on them. The NFL is not friendly to guys over 30. I'm not saying he's done, I don't know that ... but I would personally be very surprised if he's ever on an NFL field again.
So I hope he's got good lawyers, and since I don't know the fact of the case, I'm just rooting for justice. Justice, I have a feeling, however, is on the side of Steve Foley.

Sadly for some reason with the history in San Diego area Police being trigger happy it can be a bad place for a balck guy who is not a criminal but a big athetlic guy who intimidates little underpowered almost rent a cops like in Coronado this happens to often. A great young man Demetrius DuBose and Charger Linebacker who was an All American and Team Captain at Notre Dame was murdered when he was shot to death by mistake in the early 1990s in Mission Beach. All because of some paniced mistake by some little napoleonic complexed policemen.
Cops should be big guys who can handle themsleves with their fist or someother way then simply blowing people thru of holes with their pistols and shotguns.
Most Policeman are great people. But it seems like sometimes too many Barny Fifes get jobs they should never have. Give a guy who no one has ever respected as a man a badge and a gun and all of a sudden it goes to their head and they think they should blast away in order not to be humilated by looking foolish.
No more short, weak ass , chip on their shoulder cops.
You should have to be at least 6 feet and 200 pounds and know how to win a bar fight with your fist. Not just pull out your pistol and shoot because you pissed our pants because you make a mistake and challange an inocent man who is bigger and stronger than you. Like this off duty rent-a cop who could not make it in a big city police force.
God Bless Demetrius Dubose. he was murdered by the San Diego Police Department. I hope Steve Foley gets this Cops House and retirerment.

The police in Coronado are known for being the biggest a-holes in San Diego county law enforcement. La Mesa is a distant second. There are so many things wrong with this case that Steve Foley might just get a settlement. I hope he does.

I am looking forward to driving over Steve Foley bridge to Steve Foley Island and having a nice dinner at Peohe's! He would have made $10 million in 3 years - I think a $40 - $50 million check will forgive the little sissy who is afraid of african americans... oh and as rule in SD - even if you are drinking and driving, over 6' and more than 240 lbs. be careful - you might get shot!

Foley was shot 3 times, once in the hip, once in the knee and once in the hand. None considered life threating. His blood alcolol level was 3 times the legal limit. He was driving eratically , speeding, weaving, but of course in some mindes that is OK because after all he was in a rush to get home with the white hooker fugitive he had picked up in the bar.
The Chargers should offer to pay for the defence of Coronado and the cop because with out this happening they would have never found that they had another linebacker with 3 times the talent in Phillips and he is younger.

Foley is 6'4" and weighs 265 pounds.
He had been partying in downtown San Diego, had a blood alcohol level of 0.233 percent, nearly three times California's legal limit of 0.08 percent.
WOW- he must have had a lot of booze. If you drink that much and get that drunk at that time of night, you are probably going to get yourself in a HEAP of trouble. And what is this with the "lady" trying to run down the Officer with a car? Now, I don't know if the Officer acted correctly or not. But Foley and his "lady" were not acting properly. I hope the truth and justice win out. And I also wish the Tooth Fairy was real. LOL

Put yourself in the policemans place. What would you have done if you were faceing a troubled sports player with a bad rep that reached for SOMETHING in his waist band? Would you have WAITED to see if he pulled a gun and shot you?? I think not!

Your a very stupid person to say that cops should have certain size and be able to win bar fights with your fist. I would bet that you cannot fight! In addition, if for some reason you think you have some hair on your little nuts, and think you can fight, come see me!
~not a cop!

NO WAY SHOULD CORONADO BE INCLUDED IN LAWSUIT. A GUNG HO OFF DUTY COP IN CIVIES AND HIS OWN CAR, HAVING CALLED POLICE ON HIS CELL PHONE, SHOULD HAVE WAITED FOR OFFICIAL UNITS TO ARRIVE.

Since when does DUI warrant being shot three times, almost killed and loss of career along with ability of future earnings? Is that a new law in San Diego that I'm unaware of? And does not acting "properly" also get you shot now days? Give me a break. I hope Foley sues the pants off all parties involved and then comes back to take the Chargers to the Superbowl. And that cop should be banned from all Chargers games, the putz.

After seeing the cop,Foley began the chase in Coronado
and went into two different towns before he ever stopped so I think Foley better forget about the lawsuit.

As an African American male and Viet Nam Vet, I say if a white guy pulls next to your car displaying a fire arm, and not identifying himself as a policeman, lock and load, and deal with the body count later, better to be in jail, then a one way ticket to the morgue. peace out

I definitely think Foley should sue. I think there are a lot of questions about this case that need to be answered. First, why didn't the cop wait for backup? Second and maybe more important, if it is true, how did Foley get shot in the back of his legs and hips and why was I shot three times? Foley should have to do his time or fine for DUI but getting shot? I am an average sized white male and somehow I don't think I would have been shot under the exact same circumstances.
